The Children and Families (Wales) Measure 2010 (Commencement No. 5) Order 2012

EXPLANATORY NOTE

(This note is not part of the Order)

 

This is the fifth commencement order made by the Welsh Ministers under the Children and Families (Wales) Measure 2010 (“the Measure”).

This Order brings into effect section 11 of the Measure with the exception of subsections (3) and (4).

Section 11(1) requires a local authority to assess the sufficiency of play opportunities for children within its area.

Section 11(2) provides for the Welsh Ministers by way of regulations to make provision for the matters which a local authority must take into account when assessing the sufficiency of play opportunities within its area; the date by which the first assessment should be carried out; the frequency of assessments; the review of assessments; and the publication of assessments.

Section 11(5) requires local authorities to have regard to the needs of children who are disabled and to the needs of children of different ages.

Section 11(6) provides definitions of “play” and “sufficient”.

The Welsh Ministers, in exercise of the powers conferred by section 75(3) of the Children and Families (Wales) Measure 2010([1]), make the following Order:

Title and interpretation

1.—(1) The title of this Order is the Children and Families (Wales) Measure 2010 (Commencement No. 5) Order 2012.

(2) In this Order—

“the Measure” (“y Mesur”) means the Children and Families (Wales) Measure 2010.

Appointed day

2. 1 November 2012 is the appointed day for the coming into force of section 11 of the Measure (local authority duties in respect of play opportunities for children), with the exception of subsections (3) and (4).
